Who can file for divorce in Contra Costa County?

To file a divorce in Contra Costa County, at least one spouse must have lived in California for at least 6 months, and in Contra Costa County for at least 3 months before filing.

What if we don’t meet the residency requirement yet?

If you don’t yet meet the residency requirement, you may consider legal separation (for which different rules apply). Some choose separation first, then convert to divorce once residency criteria are met.

What forms are required to start the divorce process?

At minimum — a Petition for Dissolution (Form FL-100) and a Summons (Form FL-110). If you have children under 18, the UCCJEA Declaration (FL-105) is also required. Additional paperwork often includes financial disclosures, property/asset declarations, income/expense statements, proof of service, and any settlement/ judgment documents.

Do we both need to go to court hearings?

In many uncontested divorces where both parties agree and paperwork is completed properly, court appearances can be avoided entirely. Many aspects (filing, disclosures, judgments) can be handled via e-filing.

How long will the divorce process take?

The official divorce can’t be final until the mandatory six-month waiting period — measured from when the other spouse is served or responds. However, if all paperwork is handled promptly, and both parties cooperate, many couples complete all required filings, disclosures, and judgments well before that — sometimes in 4–6 weeks.

What are the most common reasons for delays or rejections?

Mistakes such as incomplete or missing forms, missing signatures, failure to exchange financial disclosures, improper service, or incorrect formatting can cause the court to reject paperwork — delaying the process significantly.

What if we have children or significant assets?

Additional forms will be required (for example child custody declarations, asset/debt disclosure, custody/visitation attachments), and the process may be more complex. In such cases, professional support is even more helpful.
