Step 1: Plan and Prepare Phase
Session Format Options:
- Joint meetings for collaboration and shared understanding.
- Individual sessions for personal reflection and proposal prep.

Define Scope of Mediation:
- Identify issues to be addressed (custody, financials, living arrangements, etc.).
- Decide which topics require immediate attention vs. those that can wait.
- Determine the amount of time required for mediation to cover all topics; time needed may change throughout the process.
Set Short-Term Timelines:
- Choose key dates for submitting required documentation.
- Establish benchmarks for proposal sharing and feedback.
Step 2: Mediation Phase
Review Interest-Based Proposals:
- Each spouse outlines personal priorities (e.g., parenting schedules, home ownership, retirement plans).
- Focus on needs, values, and goals rather than positions alone.
Issue Identification:
- Briefly go over issues previously discussed in Step 1, and/or discuss new issues
- Prioritize matters for discussion.
Negotiation:

Draft Agreements:
- Document resolutions clearly
- Outline agreed terms in adherence to Texas Family Code § 6.602
Finalize Mediation:
- Pro Se clients are encouraged to seek a licensed Texas Family Attorney outside of Divorce With Dignity – DFW’s to review the agreement prior signing.
- Review and sign finalized agreement
- Conclude mediation with clear outcomes.
